Terms of Service

These terms are the agreement between you and SellTo.us (“we”, “us”) for using sellto.us. By creating an account or buying a test, you agree to them.

1. What SellTo.us does

SellTo.us lets you describe a startup idea, app, service, product, price or ad and see how a simulated crowd of AI participants might react. Each participant is an AI persona with a made-up age, job, budget and habits. You get a report with buy, maybe and no rates, reasons, quotes, conclusions and a downloadable PDF.

2. AI results are simulations

The participants are not real people and the results are not market research data. They can be wrong, incomplete or inconsistent, and two tests of the same thing can differ. They show simulated reactions, not a forecast of real sales, sign-ups or other outcomes, and they are not scientifically validated. Use them as a quick first check, alongside your own judgment and real customer feedback. Our How it works page explains the method. We don’t promise any sales, revenue or business outcome, and you’re responsible for the decisions you make based on a report.

3. Your account

• You must be at least 18 years old and able to make a binding agreement.
• Give a real email address and keep your login private. You’re responsible for what happens in your account.
• Each person gets one free 1,000-participant test. Creating extra accounts, using throwaway email addresses or other tricks to get more free tests or invite gifts isn’t allowed.
• You can delete your account at any time from Account settings.

4. Credits, prices and payments

• Tests are bought as credits: one credit runs one test of that size. Prices are shown in US dollars on the site before you pay.
• Payments are handled by Stripe. We never see or store your full card number.
• Credits don’t expire while your account is open. They have no cash value, can’t be transferred, and are lost if you delete your account.
• We may change prices at any time. Credits you already bought keep working.
• Where sales tax or VAT applies, it may be added at checkout.

4b. Monthly plans (automatic renewal)

• What you get: a monthly plan gives you 10 tests every month of the size you chose (1,000, 10,000 or 100,000 shoppers). The plan’s tests can also be used for smaller test sizes.
• Price and renewal: your plan renews automatically every month and you are charged the monthly price shown at checkout ($49, $199 or $799, plus any tax) on the same day each month, until you cancel. We’ll tell you before any price change takes effect, and you can cancel before it does.
• Unused tests: each paid month resets your plan to 10 tests. Unused plan tests don’t carry over to the next month and have no cash value. Tests you bought one at a time are separate and don’t expire.
• Cancel anytime online: go to Account → Manage or cancel plan. Canceling stops future charges. You keep your plan’s remaining tests until the end of the month you already paid for.
• Failed payments: if a renewal payment fails, Stripe tries again for a few days. Your plan tests are paused until the payment goes through, and the plan ends if it can’t be collected.
• Deleting your account cancels your plan immediately.

5. Refunds

• If a test fails to finish, your credit is returned automatically.
• Unused one-time credits can be refunded within 30 days of purchase. Email hello@sellto.us from your account email.
• One-time tests that finished aren’t refundable, because the AI work has been done. If something went clearly wrong with a report, contact us and we’ll make it right.
• Monthly plan payments aren’t refunded for part of a month. If you were charged for a month you didn’t want and haven’t used any of that month’s tests, email us within 14 days and we’ll refund it.
• If you dispute a payment with your bank, the related credit, or that month’s plan tests, is removed while the dispute is open.

6. Discount codes

Discount codes are optional promotions. Each code has its own limits, can be used once per payment, has no cash value, and may end at any time. We may cancel codes that were shared or used in ways we didn’t intend.

7. Invite a friend

• You can share your personal invite link. When someone new signs up with it and their first test finishes, you get one free 10,000-participant test.
• Gifts only count for real new customers: a new email address, not a throwaway service, and not the same device or internet connection as you. One gift per friend, and up to 10 gifts per account every 30 days.
• Don’t spam people with your link or post it where it isn’t welcome.
• We may refuse or remove gifts that break these rules, and we may change or end the program at any time. Gifts already in your account stay there unless they were obtained by breaking the rules.

8. What you can’t use SellTo.us for

• Products or ads that are illegal where you sell them, or that promote weapons, illegal drugs, the sexual exploitation of anyone, hate or violence.
• Content you don’t have the right to use, such as someone else’s photos or brand.
• Personal or sensitive information about other people.
• Trying to break, overload, copy or get around the limits of the site, or reselling access without our permission.

Our AI checks each product before running a test and may refuse one that breaks these rules; your credit is returned when that happens. We may also remove content or close an account that breaks these rules. Content you submit is also processed under the usage policies of our AI provider.

9. Your content

You keep all rights to the descriptions, prices and photos you submit and to your reports. You give us permission to store and process that content only to run your tests, show you your results, keep the service working and help you when you contact us. We don’t sell your content or publish it. See our Privacy Policy for details.

10. Our service

The SellTo.us website, design, software and brand belong to us. You can use your reports for any purpose, including presentations and sharing with others. Please don’t copy the site itself.

We work to keep the site running, but it may sometimes be unavailable, slow or change. We may add, change or remove features.

11. Disclaimers

SellTo.us is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, including warranties of accuracy, fitness for a particular purpose and non-infringement.

12. Limits on our liability

To the fullest extent the law allows, we aren’t liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or business opportunities. Our total liability for any claim about SellTo.us is limited to the amount you paid us in the 12 months before the claim. Some places don’t allow these limits, so they may not fully apply to you.

13. Your responsibility

If someone makes a claim against us because of content you submitted or because you broke these terms, you agree to cover our reasonable costs from that claim.

14. Ending the agreement

You can stop using SellTo.us and delete your account at any time. We may suspend or close an account that breaks these terms. If we close your account without a good reason, we’ll refund your unused credits.

15. Law and disputes

These terms are governed by the laws of the State of California, USA. Any dispute will be handled in the state or federal courts in Los Angeles County, California, unless the law where you live gives you the right to another place. Before going to court, please email us so we can try to solve it together.

16. Changes

We may update these terms. If a change is important, we’ll tell you by email or on the site before it takes effect. Continuing to use SellTo.us after that means you accept the new terms.
